2. Service Description

FileCruise is a secure file hosting service that allows you to:

• Upload, store, and share files with end-to-end encryption
• Generate secure download links for your files
• Access your files from anywhere with an internet connection
• Manage your storage and account settings

Our service is hosted in Europe and complies with GDPR regulations to protect your privacy and data.

3. User Accounts

3.1 Account Creation

To use certain features of our Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We may terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time through your account settings.

4. Acceptable Use Policy

You agree not to use the Service to:

• Upload, store, or share content that is illegal, harmful, threatening, abusive, or otherwise objectionable

5. File Storage & Security

5.1 Encryption

All files are encrypted using AES-256-GCM encryption in your browser before being uploaded to our servers. We operate on a zero-knowledge architecture, meaning we cannot access your unencrypted files or recover lost encryption keys.

5.2 Storage Limits

Storage limits are based on your account type:

• Free: 5 GB storage, 50 GB monthly transfer
• Basic: 50 GB storage, 1 TB monthly transfer
• Pro: 100 GB storage, 1 TB monthly transfer
• Ultimate: 500 GB storage, 5 TB monthly transfer

5.3 File Retention

Free accounts: Files may be deleted after 90 days of inactivity. Paid accounts: Files are retained for the duration of your subscription and 30 days thereafter.

6. Privacy & Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using our Service, you agree to the collection and use of information in accordance with our Privacy Policy.

7. Payment & Subscriptions

7.1 Billing

Paid subscriptions are billed monthly or annually in advance. All fees are non-refundable except as required by law or as specifically stated in these Terms.

7.2 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can cancel your subscription at any time through your account settings.

7.3 Price Changes

We may change our pricing at any time. For existing subscribers, price changes will take effect at the next renewal cycle, with at least 30 days notice.

8. Intellectual Property

8.1 Your Content

You retain all rights to the content you upload to FileCruise. By uploading content, you grant us a limited license to store, process, and deliver your content solely for the purpose of providing the Service.

8.2 Our Service

The FileCruise service, including our website, software, and branding, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of our Service.

9. Disclaimers & Limitations of Liability

9.1 Service Availability

We strive for 99.9% uptime but cannot guarantee uninterrupted service. The Service is provided "as is" without warranties of any kind, either express or implied.

9.2 Data Loss

While we implement robust backup systems, you are responsible for maintaining your own backups of important data. We are not liable for any data loss or corruption.

9.3 Limitation of Liability

To the fullest extent permitted by law, our liability for any claims related to the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to the Service will be immediately revoked
• Your files may be deleted after a grace period (30 days for paid accounts)
• Outstanding payments remain due
• These Terms will remain in effect for any remaining obligations

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the European Union and the country where our servers are located. Any disputes will be resolved through binding arbitration or in the courts of competent jurisdiction in Europe.

For EU residents, you have the right to pursue disputes through your local consumer protection agencies and courts.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by email or through a notice on our website at least 30 days before the changes take effect.

Your continued use of the Service after the changes take effect constitutes acceptance of the new Terms.
